1. Definitions and Interpretations

Contract
The contract for the sale and purchase of the plants.

Delivery Area
Mainland United Kingdom and selected regions outside the UK – see our Shipping Information page for details.

Plants
Any live or bareroot plants available for purchase on our website.

The Seller, “we”, “us”, or “our”

2. Basis of Sale

  1. An agreement to sell plants is made on these terms when we accept an order made by you via our website. The description of the goods, the price and delivery costs are set out on the order page.

  2. We aim to supply all customers with strong, healthy plants. Normal pot sizes are:

    • Auriculas: 7 cm or 9 cm

    • Pelargoniums: 7cm or 9 cm

    • Iris: bareroot

    • Other herbaceous plants: 9cm pots   

    • Variations in size, shape or colour are inevitable with living products. Photographs are for guidance only and colours may vary slightly, especially shades of red.

  3. Orders are accepted at our discretion and only if the goods are available, correctly priced, and deliverable within our delivery area.

  4. We reserve the right not to supply any plants we deem unfit for dispatch. Where possible we will contact you to offer suitable substitutes. If we cannot reach you, we will send only the plants that meet our quality standards unless you have agreed to accept substitutions at checkout.


3. Price of the Plants

  1. Our plants are not subject to VAT as we are farm-registered.

  2. Carriage charges are detailed on the checkout page and included in the total order price.


4. Payment Terms

Payment is taken when you place your order. We accept:

  • Shop Pay, Google Pay and Apple Pay

  • Debit or credit cards (securely processed – we never store your card details)

  • PayPal

  • Direct bank transfer (details sent after checkout)

Orders are prepared once payment has been received in full.

  1. Orders will not be dispatched until full payment has been received.

  2. If payment cannot be obtained before dispatch, we reserve the right to cancel the order or suspend further deliveries.

  3. We take reasonable care to protect all payment information, but cannot be held liable for losses caused by unauthorised access unless due to our negligence.


5. Delivery

  1. We deliver to the address you specify at checkout. If no one is available, the courier may “leave in a safe place”. Please provide clear delivery instructions at checkout.

  2. You will receive tracking details by email and/or SMS. We advise not to delay delivery through courier links, as plants left in depots may deteriorate quickly.

  3. Once an order has been passed to our courier, responsibility for the parcel’s safe and timely arrival passes to you. We cannot be held responsible for courier delays, failed deliveries, or plant deterioration caused by storage in transit.

  4. Plants should be unpacked and watered immediately upon arrival.

  5. We may delay dispatch during extreme weather (for example, frost or heatwaves) to protect your plants. This does not constitute breach of contract.

  6. Typical dispatch times are within 7 – 14 working days, though some plants are only shipped at specific times of year (see product listings and shipping page for details).


6. Risk and Ownership

  1. Risk of damage to the plants passes to you at the time of delivery.

  2. Ownership passes to you only once full payment has been received.

  3. Once delivered, responsibility for the plants’ ongoing care lies entirely with you. We cannot accept liability for losses due to unsuitable storage, neglect, adverse weather, or failure to follow planting advice.

  4. Goods supplied are not for resale.


7. Returns & Refunds

Because our products are live, perishable goods, the standard 14-day “change of mind” return right under the Consumer Contracts Regulations does not apply.

We cannot accept returns or offer refunds where:

  • you have simply changed your mind,

  • plants have deteriorated due to delay in planting, lack of care, or unsuitable growing conditions.

If plants arrive damaged or incorrect, please notify us within 36 hours of delivery at info@woottensplants.co.uk, quoting your order number and attaching photographs of the plants and packaging.

  • Minor breakages (e.g. broken leaves, spilled compost) may occur and are not considered grounds for refund.

  • For significant damage or errors, we will offer a refund or replacement at our discretion.

Please retain the original packaging — we may ask you to return the plants via our carrier. We will bear return carriage costs only if we request the return.


8. Warranties

All plants are guaranteed for three months from delivery, provided they are grown in suitable conditions and cared for appropriately.
We cannot replace or refund plants that fail due to neglect, drought, frost, heat, poor soil, or other unsuitable growing conditions.
Flowering and performance cannot be guaranteed.


9. Liability

  1. We accept unlimited liability for death or personal injury caused by our negligence.

  2. We are not liable for indirect, consequential or business losses, including loss of profits or data.

  3. These terms do not affect your statutory rights as a consumer.

  4. We strive to keep our website up to date, but availability and descriptions are subject to change. Variations in plant colour, size and form should be expected.

  5. We will not be liable for delays or failure to perform obligations caused by events beyond our reasonable control (for example, extreme weather, courier disruption or power failure).


10. Copyright & Website Content

  1. All text, design and photography on our website are protected by copyright and may not be reproduced without written permission.

  2. You may print or download a single copy of pages for personal, non-commercial use.

  3. All names and logos are trademarks of Woottens of Wenhaston Ltd or their respective owners.


11. Privacy & Data Protection

We take your privacy seriously and comply with UK GDPR regulations.
When placing an order, you provide personal data (name, address, email, phone, payment details) which we use solely for processing and fulfilling your order.

  • Payments are handled securely via PayPal or Lloyds Cardnet; we do not store card details.

  • Your contact information is shared only with our courier for delivery and tracking.

  • If you subscribe to our newsletter, you can unsubscribe at any time via the link in each email or by contacting us directly.

Right of Erasure & Restricted Processing
You may request deletion of your data at any time by emailing us. We will remove your details within 30 days unless retention is required to honour a plant guarantee or comply with legal obligations.

Woottens of Wenhaston Ltd is registered with the Information Commissioner’s Office (ICO Registration No. Z6252146).


12. Changes

We reserve the right to amend these Terms & Conditions or our website content at any time. Changes will not affect existing confirmed orders.


13. Complaints

We value our customers.
If you wish to raise a concern or complaint, please email info@woottensplants.co.uk and we will respond promptly.


14. General

  1. Communication will be sent to the email address you provide; please ensure it is accurate and kept up to date.

  2. If either party fails to enforce a right under these terms, that does not waive the right to enforce it later.

  3. If any provision of these terms is found invalid or unenforceable, the remaining terms remain in effect.

  4. Headings are for reference only and do not affect interpretation.


15. Governing Law & Jurisdiction

These Terms & Conditions are governed by the laws of England and Wales.
Any disputes will be resolved exclusively in the courts of the United Kingdom.
